Waziri wa Mambo ya Nje na Ushirikiano wa Kimataifa, Mhe. Bernard K. Membe (Mb) amelaani kitendo cha kikundi cha M23 kuteka mji wa Goma na kutishia kuteka miji mingine ya Mashariki ya Jamhuri ya Kidemokrasia ya Kongo (DRC). Mhe. Waziri alitoa msimamo huo wakati alipozungumza na Waandishi wa Habari jijini Dar es Salaam tarehe 22 Novemba, 2012.

Mhe. Waziri alisema kuwa hali ya usalama mjini Goma ni mbaya kutokana na mashambulizi hayo ya M23 na hali hiyo ikiachwa iendelee, Tanzania itaathirika kwa kiasi kikubwa kwani watu wengi watakimbilia hapa nchini kama wakimbizi.

Aidha, Mhe. Waziri alisikitishwa na kikundi cha M23 cha kupuuza wito uliotolewa na viongozi wa Jumuiya ya Maendeleo ya Nchi za Kusini mwa Afrika (SADC) na Sekretarieti ya Nchi za Maziwa Makuu (ICGLR) wa kusitisha mapigano hayo.

Mhe. Waziri aliendelea kueleza kuwa Tanzania inasikitishwa na jeshi la Umoja wa Mataifa la MONUSCO lililopewa jukumu la kulinda amani Mashariki ya DRC kwa kushindwa kuchukuwa hatua za kukomesha mashambulizi hayo na badala yake kuwa mashuhuda wa mashambulizi yanayofanywa na kikundi cha M23 dhidi ya Serikali na wananchi wa kawaida.

Aliuomba Umoja wa Mataifa utoe mamlaka ili MONUSCO iwe na uwezo wa kisheria wa kukabiliana na waasi wa M23 kama sura ya 7 ya Umoja wa Mataifa inavyoelekeza badala ya kutumia sura ya 6 ya Umoja wa Mataifa inayosisitiza umuhimu wa kulinda amani bila kujibu mashambulizi.

Kuhusu jitihada zinazofanywa na SADC kwa kushirikiana na ICGLR za kutafuta suluhu ya kudumu ya mgogoro huo, Mhe. Membe alisema kuwa mwezi Agosti, 2012 Wakuu wa Nchi wa Jumuiya hizo walikutana mjini Kampala, Uganda na kuamua kuunda kikosi cha kulinda amani ili kitumwe Mashariki ya DRC. Tanzania iliahidi kuchangia batalioni moja lakini kikosi hicho cha kulinda amani hakijapata ridhaa ya Umoja wa Mataifa.

Umoja wa Mataifa hautaki kutoa ridhaa ili kikosi hicho kipelekwe DRC kwa hoja kuwa tayari jeshi la Umoja wa Mataifa lipo nchini DRC.

Mhe. Waziri alihitimisha Mkutano wake kwa kutoa taarifa kuwa nchi za SADC na ICGLR zitakuwa na mkutano nchini Uganda kuanzia siku ya Ijumaa tarehe 23 Novemba, 2012 kujadili hatua za haraka za kuchukuwa ili kukabiliana na mzozo wa DRC.

Lake Nyasa:  We have Agreed to Disagree

The Minister for Foreign Affairs and International Co-operation, Hon. Bernard K. Membe (MP), said that Tanzania and Malawi have agreed to disagree on the merits of the Lake Nyasa border dispute.

Speaking to the reporters during the joint press conference with his counterpart, Hon. Ephraim Chiume of Malawi, Hon. Membe said that there are respectively fundamental differences between the two countries.

“Malawi is still firm with Article 1, Subsection 2 of the 1890 Heligoland Treaty, which stipulates that Lake Nyasa border demarcates in the Northern part of Mozambique, which is to the Eastern shore of the Lake in Tanzania side,” said Hon. Membe.

For Tanzania, she still maintains that Article 6 of Heligoland Treaty stipulates that boundary issues shall be in accordance with the local requirements.  Thus, Tanzania still insists and maintains that the frontier demarcating between these two contiguous disputing states passes in the middle of the Lake Nyasa.

“With that, we have jointly agreed to seek a third party mediator to resolve this dispute amicably and peacefully,” said Hon. Chiume.

The parties agreed that the mediator should come from the Forum made of the former African Heads of State and Government and in particular from the Southern African Development Community (SADC).  “The Forum has 37 members who are retired, democratically elected leaders and whereby 10 of the members are from SADC countries,” said Hon. Membe.

Further to their agreement, the two Ministers told reporters that on 24 November of this year, they will hand deliver formal letter of application to the Forum.  It is said that in that application the parties will seek a mediator that is consisted of the 10 SADC members and jurists.

“We have also jointly agreed that the SADC Forum team shall have three months starting January 2013 to complete this exercise,” said Hon. Membe, adding that the team will be given additional time if necessary.

In concluding the joint press conference, both Ministers expressed their eagerness to resolve this border row amicably and peacefully.  However, if mediation process is fully exhausted, then the International Court of Justice will be the last resort.

Membe hails Angola as it marks 37th Anniversary of its Independence
